DSMenu Prohibited Activities Policy

You may not access or use the DSMenu Site for any purpose other than that for which we make the Site available. The Site may not be used in connection with any commercial endeavors except those that are specifically endorsed or approved by DSMenu.

Prohibited Activities

As a user of the Site, you agree not to:
  1. Make any unauthorized use of the Site, including collecting usernames and/or email addresses of users by electronic or other means for the purpose of sending unsolicited email, or creating user accounts by automated means or under false pretenses.

  2. Systematically retrieve data or other content from the Site to create or compile, directly or indirectly, a collection, compilation, database, or directory without written permission from DSMenu.

  3. Engage in unauthorized framing of or linking to the Site.

  4. Circumvent, disable, or otherwise interfere with security-related features of the Site, including features that prevent or restrict the use or copying of any Content or enforce limitations on the use of the Site and/or the Content contained therein.

  5. Trick, defraud, or mislead DSMenu and other users, especially in any attempt to learn sensitive account information such as user passwords.

  6. Make improper use of DSMenu's support services or submit false reports of abuse or misconduct.

  7. Engage in any automated use of the system, such as using scripts to send comments or messages, or using any data mining, robots, or similar data gathering and extraction tools.

  8. Interfere with, disrupt, or create an undue burden on the Site or the networks or services connected to the Site.

  9. Use DsMenu for any purpose other than to the benefit of single end user entity. DSMenu is intended for the use of a single party associated with a single entity. Use of DSMenu and/or DSMenu platform for the purpose of self-enrichment or selling our products, productions, software solutions, URL, images for purposes outside a single end user entity is strictly forbidden unless "affiliate" or "partnership" agreements have been executed. Organizations wishing to sell products to end user consumers of the DsMenu platform must make prior arrangements with DsMenu via separately executed "Affiliate" and/or "Partnership" agreements

    • A "single end-user entity" is defined as an end user with a separate brand, logo, or specialty service that is distinct and separate from other services within the same parent organization. Examples of "Non Single End-User"(NSEU) entities include shopping malls, strip malls, and vacation resorts with multiple store fronts all under a single parent organization.
    • The use of a single DsMenu membership to design and manage menu boards for multiple brands or entities is prohibited.
    • If it is determined that your use of DsMenu falls under the definition of a NSEU entity, as described above, you may be required, at a minimum, to subscribe to the Pro plan subscription.
    • However, it is most likely that your use as an NSEU, as determined by DsMenu, falls under the "Affiliate" or "Partnership" category, which would require individual subscriptions within/under an "Affiliate/Partnership" arrangement.
    • If you have a Standard plan but meet the definition of a NSEU entity, your account could be subject to deactivation without possibility of a refund.
    • Any and all resolutions will be at the exclusive determination of DsMenu.

  10. Attempt to impersonate another user or person or use the username of another user.

  11. Use any information obtained from the Site in order to harass, abuse, or harm another person.

  12. Decipher, decompile, disassemble, or reverse engineer any of the software comprising or in any way making up a part of the Site.

  13. Attempt to bypass any measures of the Site designed to prevent or restrict access to the Site, or any portion of the Site.

  14. Harass, annoy, intimidate, or threaten any of DSMenu's employees or agents engaged in providing any portion of the Site to you.

  15. Copy or adapt the Site’s software, including but not limited to Flash, PHP, HTML, JavaScript, or other code.

  16. Upload or transmit (or attempt to upload or to transmit) viruses, Trojan horses, or other material, including excessive use of capital letters and spamming (continuous posting of repetitive text), that interferes with any party’s uninterrupted use and enjoyment of the Site or modifies, impairs, disrupts, alters, or interferes with the use, features, functions, operation, or maintenance of the Site.

  17. Disparage, tarnish, or otherwise harm, in DSMenu's opinion, DSMenu and/or the Site.

  18. Use the Site in a manner inconsistent with any applicable laws or regulations.

  19. Use the Site as part of any effort to compete with DsMenu or otherwise use the Site and/or the Content for any revenue-generating endeavor or commercial enterprise.

  20. Use workaround methods to display contents on more screens than subscribed.

Consequences for Non-Compliance

Subscribers are cautioned to ensure they are using their subscription properly and do not violate the "DsMenu Prohibited Activities Policy." Each circumstance will require individual consideration by DsMenu. All resolutions and outcomes are at the sole discretion of DsMenu.

This policy ensures that each distinct brand or entity benefiting from DsMenu services maintains its own membership, aligning with our commitment to providing fair and individualized service to all users.
